We guarantee a 99.9% server uptime for all hosted applications. However, we do not hold liability for temporary downtimes caused by scheduled maintenance, ISP backbone failures, or malicious DDoS attacks beyond our network's immediate mitigation capacity.
The Client is solely responsible for all content, data, and files uploaded to our servers. Any hosting of explicit content, pirated software, malware, or resources executing spam campaigns will result in an immediate and permanent ban of the account without any financial refund.
To maintain the highest standard of uninterrupted service, all financial transactions must be strictly adhered to as per the agreed contractual timelines.
We understand that our software handles highly sensitive financial and personal data. Oxin Infotech implements enterprise-grade encryption and strict database security protocols. However, the Client is equally responsible for safeguarding their administrator credentials, API keys, and access tokens.
Both parties agree to hold all proprietary or confidential information in strict confidence. Oxin Infotech will not access, modify, or distribute your customer data unless explicitly required for troubleshooting purposes or compelled by a direct law enforcement mandate.
In no event shall Oxin Infotech, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any unauthorized access, use or alteration of your transmissions or content.
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes, claims, or legal proceedings arising out of or directly relating to these Terms or the Company's services shall be subjected to the exclusive jurisdiction of the competent courts located in Murshidabad, West Bengal, India.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
